Full section 31 text
31. Additional Terms for Users in the European Union
31.1. Scope. This Section 31 applies to Users located in the European Union (the “EU”), referred to as “EU Users,” and sets out additional terms under Regulation (EU) 2022/2065 (the “Digital Services Act” or “DSA”) and other EU law. It controls over any conflicting part of these Terms, and nothing in these Terms limits your rights under mandatory EU or EU Member State law.
31.2. Legal Representative and Points of Contact. Our legal representative under Article 13 of the DSA is Prighter DSA GmbH, Schellinggasse 3/10, 1010 Vienna, Austria; support@prighter.com; +43 1 997 41 24; https://app.prighter.com/portal/15981657240. EU Member State authorities, the European Commission, and the European Board for Digital Services may contact us about DSA matters at dpo@vrchat.com, in English or German. Users may contact us about DSA matters at https://vrch.at/support, in English; these requests are not handled solely by automated tools.
31.3. Content Moderation. We moderate User Content and User conduct to enforce these Terms (including Sections 8, 12, and 13), the Community Guidelines, and applicable law, and we apply our rules in a diligent, objective, and proportionate manner, with due regard to the rights and legitimate interests of all parties involved, including freedom of expression. We rely on reports from Users and third parties, review by our Trust & Safety team, and automated tools, including the Anti-Cheat Measures in Section 13.3 and automated screening of uploaded content, and we may monitor activity as described in Section 13.4. Some actions, such as rejecting uploaded content, may be taken by automated tools without prior human review. You can appeal any such action under Section 31.5. Depending on the nature, severity, and frequency of a violation, we may remove User Content or limit its visibility, restrict access to Platform features (including the VRC Creator Economy), issue a warning, or suspend or terminate your Account. Our rights in Sections 8.7, 9, 13, and 14 and elsewhere in these Terms to take these actions are subject to this Section 31, and Section 31.5 applies even where these Terms say a decision is final or in our sole discretion.
31.4. Reporting Illegal Content. Anyone may report content they believe is illegal through the in-Platform reporting tools or at https://vrch.at/support. Your notice should explain why the content is illegal, identify exactly where it is located (such as the world, avatar, User, or Group), include your name and email address (unless it concerns child sexual abuse material or related offenses), and state that you believe in good faith that your notice is accurate and complete. We will confirm receipt, review your notice in a timely, diligent, non-arbitrary, and objective manner, and tell you our decision, whether we used automated means, and how you can challenge it. Copyright notices may also be submitted under Section 11.
31.5. Statement of Reasons and Appeals. If we remove or restrict your User Content, suspend or terminate your Account, restrict your access to Platform features (including the VRC Creator Economy), or restrict payments to you, we will give you a clear and specific statement of reasons as required by Article 17 of the DSA, unless the law prohibits it. You may appeal that decision, or our decision on a notice you submitted, at https://vrch.at/support, free of charge, within six months after we inform you of it. Qualified members of our team review appeals, which are not decided solely by automated means, and we will reverse without undue delay any decision we find was wrong. We will tell you the outcome of your appeal and any other options available to you. You may also refer a dispute about these decisions to an out-of-court dispute settlement body certified under Article 21 of the DSA (listed on the European Commission’s website). Its decisions are not binding, using it does not affect your right to go to court, and fees are allocated as provided in Article 21.
31.6. Misuse and Repeat Violations. If you frequently Post manifestly illegal content, we will warn you and then suspend your Account for a reasonable period. If you frequently submit manifestly unfounded notices or appeals, we will warn you and then suspend processing of them for a reasonable period. We consider the number of manifestly illegal items or manifestly unfounded notices or appeals in a given period, their share of your overall activity, the severity of the misuse and its consequences, and, where identifiable, your intent. This does not limit our other rights under these Terms, including to terminate an Account for severe violations.
31.7. Recommendations. We recommend content such as worlds, avatars, instances, and Groups based mainly on your activity (such as content you visit, favorite, or interact with), the popularity and recency of content, compatibility with your device, and your Account and content settings, including age verification status. Your settings always apply. We use the other factors to show content likely to be relevant to you, and their weight varies by feature. You can influence your recommendations by changing your content settings and by favoriting or interacting with content.
31.8. Users Under 18. You must be at least 13 and have permission from a parent or guardian. Treat others with respect, and do not share content that is illegal, sexual, hateful, or violent, or personal information like your real name, address, or school. You can block, mute, and report anyone who makes you uncomfortable. If we remove your content or suspend your Account, we will tell you why, and you can ask us to review it. This summary does not replace the rest of these Terms.
31.9. Consumer Rights and Disputes. If you are an EU User acting as a consumer: (a) Section 25 does not deprive you of the protection of the mandatory consumer protection laws of the EU Member State where you live; (b) Section 27 does not apply to you, and you may bring proceedings against VRChat in the courts of the EU Member State where you live, which are also the only courts in which VRChat may bring proceedings against you; (c) Sections 8.7, 9.1(e), 19, and 21 through 24, and the parts of Section 2 under which a User under 18 waives the right to void these Terms and a parent or guardian guarantees that User’s obligations, apply only to the extent permitted by applicable law; and (d) nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence, and liability for fraud, gross negligence, or willful misconduct.
31.10. Changes to these Terms. In addition to Section 19, we will notify EU Users of significant changes to these Terms by email or in-Platform notice before they take effect. A machine-readable copy of these Terms is available at https://hello.vrchat.com/s/tos.txt.
